Rules for buying and selling goods in the online store https://www.diaura.lt:

1. General provisions.

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”) are purchase and sale agreements, which are concluded between UAB “Eidvina”, comp.code. 304176340, registered office address Gailiūnų str.45, Druskininkai municipality, E-mail: info@diaura.lt (hereinafter – the Seller) and yours (hereinafter – the Buyer).

1.2. It is a mandatory legal document that establishes the rights and obligations of the Buyer and the Seller, the procedure of purchase and delivery of goods, the liability of the parties and other provisions related to the purchase and sale of goods in https://www.diaura.lt online stores.

1.3. All legal and natural persons who have reached the age of adulthood and whose actions are not restricted by court order have the right to buy in the online store in the https://www.diaura.lt  and minors from the age of 14 to 18 who have  the consent of their parents or carers, unless they independently dispose in their income. 

1.4. The buyer, in accordance with the approved rules, guarantees that, in accordance with point 1. 2. of the rules, has the right to purchase goods in the https://www.diaura.lt online store.

1.5. The Agreement between the Buyer and the Seller is deemed to have been concluded from the moment when the Buyer after creating a shopping cart in the store, indicating the place of delivery, choosing the payment method and getting acquainted with the rules, click the button “ORDER”.

1.6. Each contract concluded between the Buyer and the Seller is stored in the https://www.diaura.lt online store.

2. Protection of personal data.

2.1. When performing electronic commerce, the Seller ensures the provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania according to the order of the Director of the Inspectorate  and other legal acts.

2.2. The Buyer can order goods in the https://www.diaura.lt online store by registering and entering the data requested in the registration.

2.3. When registering in the https://www.diaura.lt online store, the Buyer must provide correct personal information. The buyer is responsible for providing the correct data.

2.4. By approving these rules, the Buyer agrees that the personal data provided by the Buyer will be processed for the sale of goods and services in the https://www.diaura.lt online store, for the purposes of analysis of the Seller’s activities and direct marketing. The Buyer also agrees that informative notices specified by the Buyer are sent to the postal address and telephone number, required for the performance of this contract.

2.5. The buyer, when registering by e-mail in the store and when ordering goods, undertakes to protect and not disclose login details to anyone.

3. Buyer’s rights and obligations.

3.1. The Buyer has the right to purchase goods in the https://www.diaura.lt online store in accordance with these Rules and order specified in other information sections of this e- store.

3.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods with https://www.diaura.lt online store within 14 days from the date of delivery of the goods, notifying the Seller in writing, except  the cases when the contract cannot be withdrawn under the laws of the Republic of Lithuania (eg. when the contract is concluded  for the sale of precious metals and their products).

3.3. The Buyer undertakes to check the condition of the shipment and accept the delivered goods.

3.4. If the Buyer’s data provided in the registration form changes, the Buyer must update it immediately.

3.5. The Buyer undertakes not to transfer his/her login data to third parties, and in case of loss of the login data, he/she must immediately inform the Seller.

3.6. The Buyer, using the https://www.diaura.lt online store, agrees with these Purchase and Sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.

4. Seller’s rights and obligations.

4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the https://www.diaura.lt online store.

4.2. The Buyer is prohibited from using the Store in a manner that may endanger the proper functioning of the Store, its security, integrity or restrict the access of other persons to the Store. If the Buyer tries to damage the stability and security of the https://www.diaura.lt online store, the Seller has the right to immediately and without notice restrict, suspend or cancel the Buyer’s access to the https://www.diaura.lt online store, not to fulfill his/her orders .

4.3. The Seller undertakes to respect the Buyer’s right to privacy of the personal information belonging to the Buyer specified in the https://www.diaura.lt online store registration form and not to transfer it to third parties, except the cases when this information is necessary to fulfill the Buyer’s order.

4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

5. Ordering goods, terms.

5.1. In the https://www.diaura.lt online store, the buyer can buy online 7 days a week, 24 hours a day.

5.2. If the product is in the Seller’s warehouse at the time of ordering, the Seller will send the product to the Buyer within 1-3 working days after payment of the order.

5.3. If the goods are not in the Seller’s warehouse at the time of ordering, an order is formed, which the Seller checks and notifies the Buyer of the delivery deadline by e-mail or a message. The goods shall be sent to the Buyer within the time required for its manufacture and dispatch.

5.4. The Agreement shall enter into force from the moment when the Seller confirms the order and sends it by sending a confirmation letter to the e-mail address specified by the Buyer.

5.5. The buyer undertakes to pay for the goods within 48 hours of receiving the order confirmation by e-mail. Only after receiving the payment for the goods, the formation of the parcel of goods begins and the term of delivery of the goods begins to count.

5.6. If the buyer fails to make the payment within 48 hours, the order will be canceled.

6. Delivery of goods.

6.1. When forming an order, the buyer undertakes to indicate the exact place of delivery of the goods, postal code, to indicate the correct telephone number of the consignee.

6.2. The buyer undertakes to pick up the goods himself/herself or the parcel can be picked up by a person at the address specified in the order. If the Buyer or other persons at the address specified in the order are unable to collect the goods and the goods are delivered to the correct address or the specified post office address, the Buyer has no right to make claims to the Seller for non-fulfillment of delivery terms.

6.3. The Seller shall not be liable for non-delivery or late delivery of the goods ordered by the Buyer if it was due to the fault of third parties or due to circumstances beyond the Seller’s control and reasonable foresight at the time of concluding the sale and purchase contract.

7. Intellectual property.

7.1. All rights to the Store and the works in it are reserved. No content or information contained in the Store may be reproduced, made available to the public or distributed without the prior written consent of the Seller.

7.2. All trademarks displayed in the Store are the property of the Seller or the Seller lawfully uses them.

8. Final provisions.

8.1. These Rules of Purchase and Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania. The law of the Republic of Lithuania shall apply to this Agreement.

8.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.

9. Validity of the Rules.

These rules are valid indefinitely.
